The most of the Linuc Community are sitting, waiting with itching fingers to rewrite any infringing code. SCO will not be able to win or even lead a case without disclosing the actual infringing code (if any). As soon as that happens, the code will be rewritten and I think it will happen dead fast, so you'll just change to the newer kernel/abi's/header files, that's not infringing and the whole case goes away.
In any sensible country (like Germany, but seemingly not the USA) would not allow anyone to sue end users before the claim that they were infringing was proofed.
