I am a retired attorney, once big-time, who decided to spend the second half of his life doing peaceful things like trading baseball cards. Man, did the thieves and Ebay and PayPal turn me into an attorney again. I am personally suing both of them along with some scammers for computer fraud (their computer contracts which no one ever read - I now have - are totally unenforceable), but I'm going for the big guns here, unfair trade practice, CIVIL RICO, and violation of securities laws.


Tell your friends. Pass the word around. If anyone wants to get involved in this lawsuit just to get even with these bastards that's a good enough reason for me. Now, because I'm a retired attorney, I can only represent myself, so what I need to do is get a list together of others willing to go forward with me and I'll get other lawyers for you.

    Hello, and you had better believe if it can be done on a contingency, as Ebay has more money then God, you ha dbetter believe I want to sue them. After 4 years with 1680 feedback at 99.6%, they suspended me permanantly because anyone can get anyone suspended, if they do not like them, report their items as infringing and you're off. As you know there is no one to talk to there, their customer support may as well be robots. I sent in an email from the person we had been stalked by for almost a year, as a result of Ebay, by phone, plastering our names, phone and address all over Craigslist getting 300 calls a day, and then they attacked my Ebay account. I had all trademark owners who the stalker & Ebay accused me of INFRINGING. verify all items were authentic AS THEY WERE and i had never sold a replica or infringing item. THAT SHOULD BE SUSPENDED. They do not take your track record of happy buyers in consideration, at all. I have been accused of slander, listing replicas, and it makes me look like a criminal to the buyers I had. Ebay was my only job, and I was accused of false violations I did not do and have the proof. I tried telling their support this to no avail, they never even read our emails. I definitely would like to go in on a lawsuit, I would like to see Ebay go broke, actually with all the suits they are getting and they deserve it, but unfortunately, none of the suits hurt them financially.       I would be interested in getting in on this. my account was suspended for having 1.1% negative and this was considered and "unacceptable level of customer dissatifaction" and I was sent notice that I will be prosecuted if I use their site in any way.

    I recently had a account on ebay suspended I was a powerseller on ebay and have been a member for over 2yrs. This was me and my sons business I'm currently disabled not looking for handouts but tired of nothing being done by ebay!.We had 100% positive feedback and didn't even have a neutral. The only reason we were given was this email.

    When asked what the suspension was for this is the response I got it took 4 to 5 weeks to even get this response. The site says 24 to 72hrs.

    the "Abusing eBay" section of the eBay User Agreement. The section

    In order for your account to be considered for reinstatement, it is
    necessary that you complete all of the steps outlined below:

    1. Read eBay's User Agreement. A link to the User Agreement can be found
    at the bottom of most eBay pages.

    2. Provide information by fax that confirms your identity, allows us to
    review your current business practices, and verifies that you have read
    and understood the eBay User Agreement.

    Please send all of the following:

    - A legible copy of the front and back of your driver's license or other
    government issued ID.
    - A copy of a recent credit card statement clearly showing the first and
    last 4 digits of the card number and your billing address as proof of
    your registration information.
    - Copies of manufacturer invoices or any other documentation showing

    I still have no reason as to why I'm suspended and I believe ebay is using there power to get information that isn't relevant in this situation since I was really never given a reason.
    What can be done about this? I'm in and anything else you need let me know.

      I'm going through the same thing with eBay right now, but I'll be damned if I give them any more information. My problem started when I reported one of my buyers who I suspected was fraudulent (no feedback, 3 different names, 2 different shipping addresses). I sent an email to eBay and then called PayPal to report the guy and within hours my account was suspended. Not his though. Then when I appealed I got the same email you did ..... 5 days later. I had already been ID verified, SquareTrade verified, so why do they need all that on me again when I reported someone for being fraudulent. So much for trying to do the right thing. I will never work with eBay again.

        Hey Guys. I thought I was the only one. I just googled Paypal sucks to see if anyone else has had problems....I feel btter knowing I am not alone...my account has been suspended/limited and all my auctions cancelled. They said because of safety concerns and they gave me the list of items to send like yours...where else can I sell?

    My frioend was thrown off for being affiliated with a suspended user...They never answred her email, they basically set her up for fraud, wouldn't let her access her sold listings, or any other auction info, she is in hospital now, blood pressure through the roof, buyers calling and emailing daily as ebay told them not to complete their transactions, and no where in the agreement does it say you cannot associate with a suspended user....She is friends with this person and borrowed her comperter when she got a virus. She had 650 pos feedback, was id verified, powerseller silver,square trade verified, and more. SHE REALLY WANTS TO SUE!

    I am ready willing and able to join forces to put these greedy b*ast*ards in their place. I had been notified of a class action lawsuit that took place about a year ago, recently I was told Iwould be getting a settlement but have not seen one dime of it nor do I know how much I was supposed to get.

    My drama with ebay continues, now due to some bullsh*t (pardon my Italian, I am VERY ANGRY RIGHT NOW) PayPal has now "restricted" both of my PayPal accounts. I have over $200 locked up in there, I can not print postage and yet part of their requirement to get unrestricted is to provide proof that these items (which were paid for just 24 hours before the lock down on my account-during a week end no less) were mailed. I called these people on the phone at PayPal and they obviously got their training from the great eBay school of ignorance because they were just as helpful as the customer service @ Feebay. ZILCH.

    Oh and another thing, they cancelled one of my auctions because I was describing a leather vest that had a patch on it that said I SURVIVED SHIT CREEK WITHOUT A PADDLE. The voice onthe phone said that profanity is not allowed. Gee, this from a site that sells SEX TOYS?

    And what is up with these MYSTERY Envelopes that are selling for big bucks? I say that ebay is behind that to get us suckers to list ridiculous items so they can make their fee. For heavens sake one auction shows a baby picking his nose and what you win is a tiny envelope with a surprise. I am not kidding look up item Item number: 5606174122

    I figured something out yesterday that I think will make people think twice about selling on ebay:
    Let's say you list something for 19.99
    it costs you 1.05 to list it
    1.05 final value fee
    the buyer pays you by Paypal, so now you are charged a percent of the TOTAL which means they are getting a fee on the shipping costs

    Let's say the shipping is $11.90 and the person wants insurance, you are charged a percent on that insurance too!

    So now PayPal takes $1.26
    So it has cost you $3.36 to sell one item for less than $20

    Let's say you sell 100 items at that price this month

    Your ebay and PayPal fees are $336.00
    That's a lot of money.

    OK, OK, I've learned my lesson. I've bought 20 or 30 things from eBay over the last couple of years, hardly a power buyer, but enough to learn that I'd be better served by the trolls on the New York subway "ay meester wanna buy a watch?" than the scam artists who infest eBay AND who eBay protects like a mother hen.
    TO be fair, about half of the items I bought on eBay were as represented; but woe be unto any buyer who DARES to question a seller, or challenge eBay's practices. My most recent - and LAST purchase, ever - was a "universal" (my first mistake!) power car antenna that could not possibly fit into my Volvo unless I followed their instrustions (to drill a few holes in the side of my car???). I returned the unit to Mr. 100% Satisfaction Guaranteed, and he has been generally ignoring my requests for my refund since May. I reported this to eBay, who replied to me with a few emaiols telling me to piss off.

    Willing to join any group to fight them.

    I will gladly join your lawsuit. I was scammed twice at ebay..once for $193.00 for a keyboard that was sent to me broken and the thief moved to avoid being caught, then again for a TV monitor for $43.00 which was never sent to me. Each time I used to access ebay I could get "my ebay" to check the status of my wish list...now, if I even attempt to bid, they make me re-register every time. I have had it with ebay and paypal..they are a group of theives operating a computer scam. I,too, am retired...I was once Director of Data Processing for the State of Maryland, and I know that these folks are cheating their clients!

        ok I know you are going, yeah, tell us something we dont know. so here is my story.

        I have been a seller on ebay for way better than a year. I have positive feedback of 81, not a big guy, but I was at least not a noob.
        I buy and sell play stations and xbox etc. I posted a xbox system and a dvd rom for one up for sell.
        Both "sell", yeah rite.
        The system, is desinged to seperate YOU the seller from your final value fee's. And then tell you to go jump off a bridge.

        The first one, the complete system, the buyer was from africa,(can you say SCAM?) My listing clearly says, I ship to NORTH AMERICA ONLY. Nuff said. That one they close, and credit back EVENTUALLY, after telling me to contact my buyer and work it out. WHAT PART OF I AINT SHIPPING TO AFRICA DONT YOU GET?

        Second one, the dvd rom for a xbox. The kid(I am assuming he is a kid) emails me tells me its his first day on ebay and he has no plan to pay for this(game to them).
        I file for credit, cut an dry simple enough rite? NOPE.
        I am supposed to contact my buyer and work it out if we can. THEY have emailed me and told me that they are not gonna buy it. Oh well you have to wait 7 days to file that!!!!!!!!!! WHY?
        customer support? you even try to get these clowns you are in for a ride. Good luck getting a phone number or an email address to just send a complaint to. OH NO
        You have TO JUSTIFY the need to contact them first. I AM A CUSTOMER, you need to justify the need for me to spend my money.
        Any way, long story short, I find their chat help location(dont bother more of the same)
        well it leads back to the same lip service, you need to contact the buyer and work this out. NO you(EBAY) need to get your collective heads removed from your rectums.
        I have even sent them a copy of the email, from the "buyer", they tell me to wait and work it out with them.
        Oh geeze believe I will NEVER EVER EVER SELL on ebay again.

          I have been with ebay since 1999. Never had a problem buying maybe I was lucky, always got my stuff, no complaints BUT as I became a seller and have a feedback of 144 i know is not a power seller status. One day got suspended don't know why or for how long. And as you know customer service through emails sucks! I searched google and just found a phone number to call ebay direct which I plan on doing tomorrow, I called it does work. Pass this on and hope this helps anyone resolve problems.       I hope you guys don't mind if I post here (being a newbie etc) but after many many months of hearing about how people have been getting more concerned about Ebay, some of the members and their customer service, we have just launched our own videogames and gaming related auction site. http://www.videogameauctions.co.uk will be gaming specific but will include development sub-categories as it seems Ebay have a habit of pulling these auctions from their site.
      If you do have time, please feel free to pop by and have a look. We only launched last Thursday and are still in final beta stages, but everything being posted is real and available to bid on. During the next few weeks there are no charges so no risk.
      Of course we're after members and I wont pretend we're not, but I feel it is important to let people know that we can make a difference to the online auction marketplace, we will listen to people's grievances and we will mediate where we can in roder to help both parties and people will not be banned or reprimanded without a proper reason and of course proper notice.
      Anyway, please accept my apologies for coming here with this, I simply went to google and put in 'ebay sucks' and here I am.

        I'm bone fide British journo investigating eBay for a news story for national British newspaper

        I'm particularly interested in the fact that ebay turns a blind eye to fraud

        Allows very libellous feedback from the frausters to remain on your account - even when they have closed the fraudster down

        ie their rules transcend the laws of the land

        eBay atre 'control freaks' ie troublemakers are only allowed to send very few PMs to sellers and other buyers

        etc etc

          eBay sucks alright, They cancelled yet another one of my auctions last night only 24 hours from the end claiming “Keyword Spamming”.

          The item was a lawn tractor, This particular brand back through the 1980’s when this machine was built not only built their own equipment but also was somehow involved with John Deere and later Cub Cadet and sold lawn tractors under their nameplate and color that were built by John Deere and Cub Cadet (much like Sears does today with the Craftsman lawn tractors).

          Now herein lies the problem, By putting (not John Deere Cub Cadet) in the title I was intending to express this was not BUILT by John Deere or Cub Cadet, It wasn’t intended as keyword spam or search engine manipulation at all, Just a statement of truth and fact.

          So if your still with me on this, Hasn’t eBay now outlawed the TRUTH by canceling this auction?? LMAO

          For those who have been burned by sellers on E-bay, Know we aren’t all like that. I have been selling on eBay for over 5 years and (knock on wood) haven’t had too much trouble from bidders. I’m probably overly cautious about who I buy from and have never bought anything from outside the U.S. and Canada. It’s the worlds largest garage (or perhaps garbage) sale and you just have to try to look at who your dealing with and what possible recourse you may have should things go bad. Also I don’t buy from anyone that doesn’t at least put their E-mail address if not a phone number in their listing. I quit putting my phone number because I was tired of answering the phone at 3am, But I still have my E-mail address right on the auction page.

          Also look at things like E-mail addresses, AOL and a lot of the free E-mail services use spam control that may block your messages. So I always try to contact the person before I bid so I know communication is possible. If the e-mail address is from a site you never heard of go look at that site. A lot of us have our own websites we use for sales or just for hosting pictures, You can look up who owns the website too and get a better idea of who your dealing with. Many like me are quite visible once you start looking at things like that. And for those who might be looking, I own a total of 6 websites, None of which make me any money though. LoL

          Is eBay a rip off, Hell yea it is!! But unfortunately some like myself are stuck with it until something better comes along.

        I listed an item on Ebay for the first time this week. Nothing expensive - a baseball cap worth under 30 bucks. The auction was going fine for 10 days. Then when I went to see who won my auction on the last day I got this nasty email from Ebay telling me that they cancelled my auction, that I was in violation of their listing policies and they threathened to ban me from their site! I learnt the hard way that I can't mention 2 brand names in a listing title. Ok fair enough, I'm a beginner, I didn't know the rules and I made a mistake. I included 2 brand names in my title (like tens of thousand other listings do). But I don't see why Ebay waited untill the last second of my 10 day auction to cancel my listing. This is ridiculous and their reaction is way over the top and aggressive. I would have happily made a change to my listing if they just told me about the problem in the first place. Many people wasted their time bidding on the item for 10 days and Ebay pulled the carpet under their feet at the last second. What is that all about?? What a waste of time for everyone involved.

          I sent 1000 dollars through ebay using western union wire transfer. I was told in an email that the transaction was insured, however when I never recieved the product and the seller refused to contact me I was told there is nothing I can do except call the police, he lived in Romania so I don't think theres any chance in getting my money back. They made it out I was the one in the wrong. Not the fraudster, MUTOIU GELU.

              You gotta be careful of ebay suspending you for using some dropshippers now. I got suspended and ebay wanted me to fax them my proof of purchase on some items. I complied and they suspended me and everyone else who used that dropshipper, saying the merchandise wasn't authentic. I got a signed statement from the manufacturer after sending them a sample of the merch, and it didn't do any good.

                I have been selling vehicles on eBay since 1999..

                The place just sucks more each year! Scammers Everywhere! They refuse to clean the dump up! After they killed one of my listings saying my acct was hijacked, I sent a nasty gram to Bill Cobb and a few others.. They suspended me.. Figures!!

                    ebay doesn't suck. iOffer sucks!! I have been a member of ebay for 6 years, never had a problem. I bought something on iOffer from ivannamovie. She said it was the original and when I received it, it was obviously a home taped copy. She didn't even bother to label it professionaly. White label with black print: "Queen". That was it. How Blatantly Bogus! Anyway, I returned it. She hasn't refunded my money yet for the misrepresented item. Numerous emails to her, probably 6 or 8. She responds by saying she was busy, what is my paypal addy, or, she thought paypal already refunded me, then she asked again for my paypal address. What a DITZ!! I contacted iOffer after a month, no response. Two weeks later tried again. No response. The seller keeps responding to my emails by saying "What is your paypal address so I can refund you". Did I say what a DITZ? Please!! I humored her dumb ass by giving it to her each time, even tho it is in her pay pal log since that is how she got my payment. She still hasn't refunded me, this is obviously a thief stalling for time. So I gave her a negative and still iOffer won't respond to me and neither will Paypal. I've always gotten satisfaction from ebay. They are the class act.
